Terms & Conditions of 'Lily & Sparrow Vintage Tea Party' Hire
All orders accepted are accepted subject to the following terms and conditions.
Items in the Lily & Sparrow collection are of good ‘vintage’ condition, therefore due to the nature of the items, it is to be expected that some of the patterns, gilt edges, and silver-plating on some of the vintage items may be worn due to age. The item classifications used by Lily & Sparrow are to be used as a guide only. Specific sizes and dimensions cannot be guaranteed. Lily & Sparrow reserve the right to supply contemporary pieces where the pieces are considered appropriate for a ‘vintage’ theme. Some cutlery is silver plated or EPNS.
Cost of Hire
The “Cost of Hire” means the total cost of the hire of all items plus any additional (optional) services selected.
Lily & Sparrow require a deposit representing 50% of the Cost of Hire as confirmation of your order (“Confirmation Deposit”). Your order will not be confirmed until this payment is received by Lily & Sparrow. Please refer to the ‘Cancellation’ section below for the situations when the Confirmation Deposit may be refunded.
The balance of the Cost of Hire is payable no later than 14 days prior to the beginning of the Hire Period. We accept payment by cash, cheque or PayPal.
Along with the balance, Lily & Sparrow require a refundable breakages deposit representing 50% of the Cost of Hire (“Breakages Deposit”) which must be paid separately no later than 14 days prior to the beginning of the Hire Period. This will be refunded upon safe return of the hired items in the same condition as they were received from Lily & Sparrow. Please refer to ‘Loss and Damage’ for more information about the Breakages Deposit.
If the Hirer cancels the hire within 28 days of the beginning of the Hire Period, the Confirmation Deposit will not be refunded. This does not affect any statutory rights which you may have.
The Hire Period is a maximum of 3 days from the point of delivery or collection until the point when the items are returned and accepted back into the possession of Lily & Sparrow. Each additional day will be charged at 20% of the total Cost of Hire.
Loss and Damage
The Hirer agrees to return all hired items in the same condition as that in which s/he received them from Lily & Sparrow.
It is the Hirer's responsibility to check items on collection for any damage including breakages, chips and cracks. Any problem with the received items should be communicated to Lily & Sparrow at that time. The Hirer will be required to sign acceptance of the hired items in the condition received.
Upon signing, the Hirer will become responsible for the hired items and any loss or damage to the hired items which were not communicated to Lily & Sparrow on receipt. Please note that the crockery is more fragile than commercial catering crockery and extra care should be taken when handling the hired items.
Any breakages, damages or loss sustained to a hired item during the Hire Period will be charged at 5 times the hire charge of the individual item as set out on the Lily & Sparrow website (whether or not the item was hired individually or as part of a package) . This includes damage/stains to linen.
Lily & Sparrow will notify the Hirer of any item(s) found to be damaged, broken or missing within 5 days of the end of the Hire Period and the appropriate charge will be deducted from the Breakages Deposit (as explained above). If the total cost of breakages exceeds the amount of the Breakages Deposit, the balance will be payable to Lily & Sparrow within 7 days of the end of the Hire Period.
No item may be substituted for any item damaged, broken or missing in lieu of a deduction from the Breakages Deposit.
If there are no items damaged, broken or missing on return, the Breakages Deposit will be returned in full to the Hirer within 5 days of the end of the Hire Period. If hired items have been found to be damaged, broken or missing and deductions are made from the Breakages Deposit, any remaining balance will be returned to the Hirer within 5 days of the end of the Hire Period
Lily & Sparrow agrees to hire the goods to the Hirer for the Hire Period. The goods shall at all times remain the property of Lily & Sparrow. The Hirer is solely accountable for the goods for the duration of the Hire Period. The agreement for hire is between Lily & Sparrow and the Hirer. The hired items are not to be used by any third party.
Lily & Sparrow accept no responsibility for any losses, costs, expenses, injury or damage to persons or property arising from the hire, however caused. Lily & Sparrow will not accept liability for any claims that arise from any event concerning or involving items hired from Lily & Sparrow, under any circumstances.
If the Hirer chooses to hire tablecloth(s), the Hirer will not undertake to launder or otherwise clean the linen. The cost of laundry is included within the price of hire. The Hirer agrees to keep all linen dry.
If the Hirer chooses to purchase Lily & Sparrow's washing up service, s/he agrees to empty or remove any food or drink from the hired items before returning them.
If the Hirer chooses to wash the hired items his/herself, this must be by hand prior to the end of the Hire Period. The Hirer agrees not to place the items in a dishwasher or any other commercial machine.
When the items are returned, if they are not of the same level of cleanliness as they were when the Hirer received them, Lily & Sparrow reserve the right to charge the Hirer for the washing up service.
